Kirac\u0131 vermi\u015f oldu\u011fu bu beyan\u0131ndan sorumludur. G\u00fcn\u00fcm\u00fcz, kira ili\u015fkilerinde en \u00e7ok duydu\u011fumuz husus olan tahliye taahh\u00fct\u00fc belirli \u015fartlar\u0131 kar\u015f\u0131lamak zorundad\u0131r. Bu konuda Yarg\u0131tay&#8217;\u0131n bir \u00e7ok karar\u0131 mevcuttur. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">YARGITAY KARARLARI<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Taahh\u00fctname her ne kadar bo\u015f olarak imzalanm\u0131\u015f ve \u00fcst k\u0131sm\u0131nda yer alan bilgiler sonradan doldurulmu\u015f ise de ge\u00e7erlili\u011fini korumaktad\u0131r.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u00ab&#8230;Daval\u0131 imzas\u0131 inkar edilmeyen taahh\u00fctnameyi bo\u015f olarak davac\u0131 tarafa vermekle bunun istenildi\u011fi gibi doldurulabilece\u011fini pe\u015finen kabul etmi\u015ftir. Bunun sonucuna da katlanmas\u0131 gerekir..\u00bb (YHGK, T.27.1.1999, E.6\u201329\/K.11 )S\u00f6zle\u015fmeye esasl\u0131 ayk\u0131r\u0131l\u0131k, alt kirac\u0131ya kiralama vb.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Taahh\u00fctte bulunan bilgilerin sonradan eklendi\u011fi iddias\u0131n\u0131  kirac\u0131 yaz\u0131l\u0131 bir \u015fekilde ispatlamal\u0131d\u0131r.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u00ab.. Taahh\u00fctteki imzan\u0131n daval\u0131 eli \u00fcr\u00fcn\u00fc oldu\u011fu, di\u011fer yaz\u0131 ve rakamlar\u0131n daval\u0131 eli \u00fcr\u00fcn\u00fc olmad\u0131\u011f\u0131 tespit edilmi\u015ftir. Tahliye taahh\u00fcd\u00fc alt\u0131ndaki imzan\u0131n daval\u0131ya ait oldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131na g\u00f6re taahh\u00fctteki tanzim ve tahliye tarihlerinin sonradan daval\u0131 r\u0131zas\u0131 hilaf\u0131nda dolduruldu\u011fu daval\u0131 taraf\u00e7a yaz\u0131l\u0131 bir belge (kesin delil) ile kan\u0131tlanmas\u0131 gerekir. ..\u00bb  Y 6 HD 2013\/13547 E., 2014\/5798 K)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Birden fazla kirac\u0131n\u0131n olmas\u0131 durumunda tahliye taahh\u00fct\u00fc t\u00fcm kirac\u0131lar taraf\u0131ndan verilmelidir. <\/strong><\/li>\n<\/ul>\n\n\n\n<p>Birlikte kirac\u0131l\u0131kta tahliye taahh\u00fcd\u00fcn\u00fcn t\u00fcm kirac\u0131lar taraf\u0131ndan verilmesi gerekir. Aile konutunda e\u015fler birlikte taahh\u00fct verebilece\u011fi gibi birinin verdi\u011fi taahh\u00fcde di\u011fer e\u015f a\u00e7\u0131k\u00e7a r\u0131za g\u00f6sterebilir. (TMK m.194\/1 , TBK m.349)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kira s\u00f6zle\u015fmesi ile ayn\u0131 tarihli taahh\u00fct ge\u00e7erli olmayacakt\u0131r.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u00ab&#8230;. &#8230;kira s\u00f6zle\u015fmesi ile ayn\u0131 tarihte d\u00fczenlenen tahliye taahh\u00fcd\u00fcn\u00fcn yasal ge\u00e7erlili\u011fi bulunmad\u0131\u011f\u0131 g\u00f6zetilmeden..\u00bb (Y 6 HD 2015\/7505 E. , 2015\/10435 K. ) Bunun istisnas\u0131 ; Yenilenen kira s\u00f6zle\u015fmeleridir. \u00ab&#8230; yenilenen kira d\u00f6nemlerinde s\u00f6zle\u015fmeyle birlikte verilmi\u015f taahh\u00fct ge\u00e7erlidir &#8230;\u00bb (Y 6.H.D. 2015\/5363 E. , 2016\/1143 K.)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Taahh\u00fct tarihi bulunmasa da taahh\u00fctnamede kira ili\u015fkisinin devam etti\u011fi beyan edildi ise taahh\u00fctnamenin s\u00f6zle\u015fmeden sonra imzaland\u0131\u011f\u0131 kabul edilir.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u00ab&#8230;tanzim tarihi bulunmasa da tahliye taahh\u00fcd\u00fcnde &#8220;i\u00e7inde kirac\u0131 olarak bulundu\u011fum&#8221; ibaresi yaz\u0131lmas\u0131 nedeni ile kira s\u00f6zle\u015fmesinden daha sonra d\u00fczenlendi\u011fi anla\u015f\u0131lan tahliye taahh\u00fcd\u00fcn\u00fcn ge\u00e7erli oldu\u011funun kabul\u00fc gerekir&#8230;\u00bb ( Y. 3. HD 21.02.2023 T. 2022\/8307 E. , 2023\/168 K. )<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Hakim \u00f6n\u00fcnde beyan edilen tahliye taahh\u00fct\u00fc ge\u00e7erlidir.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-left\"><br>\u201cDavac\u0131 ile daval\u0131 aras\u0131nda kira ili\u015fkisi konusunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Nitekim, davac\u0131n\u0131n yapt\u0131rm\u0131\u015f oldu\u011fu evde kirac\u0131 oldu\u011fu daval\u0131n\u0131n kabul\u00fcndedir. Davac\u0131n\u0131n ihtiyac\u0131 nedeni<br>ve temerr\u00fcde dayal\u0131 olarak a\u00e7m\u0131\u015f oldu\u011fu bu davan\u0131n yarg\u0131lamas\u0131 s\u0131ras\u0131nda daval\u0131 09.09.2004 g\u00fcnl\u00fc oturumda, dava konusu evi bo\u015faltaca\u011f\u0131n\u0131, mevsim nedeniyle ev bulman\u0131n zor oldu\u011funu, kendisine s\u00fcre verilmesini ve bu s\u00fcrenin sonunda evi tahliye edece\u011fini bildirmesi \u00fczerine, davac\u0131 vekilinin tahliye konusunda net bir tarih verilirse anla\u015fma sa\u011flanabilece\u011fi beyan\u0131 \u00fczerine, daval\u0131 hen\u00fcz yarg\u0131lama devam ederken 01.03.2005 tarihi itibariyle evi bo\u015falt\u0131p davac\u0131ya teslim edece\u011fini tutana\u011fa ge\u00e7en beyan ve imzas\u0131 ile taahh\u00fct etmi\u015ftir. Yap\u0131lan bu taahh\u00fct hakim \u00f6n\u00fcnde yap\u0131lan taahh\u00fct olarak ge\u00e7erlidir. Bu durumda mahkemece daval\u0131n\u0131n taahh\u00fct etti\u011fi tarih itibariyle ta\u015f\u0131nmaz\u0131n tahliyesine karar verilmesi gerekir\u2026\u201d (Yarg\u0131tay 6. Hukuk Dairesinin 11.7.2005 tarihli ve E. 2005\/5933 K. 2005\/7384 say\u0131l\u0131 karar\u0131)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>T\u00fczel ki\u015fi kirac\u0131larda taahh\u00fctname imza yetkilisi taraf\u0131ndan verilmelidir.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Kirac\u0131 ger\u00e7ek ki\u015fi olabilece\u011fi gibi, t\u00fczel ki\u015fi de olabilir. T\u00fczel ki\u015finin kirac\u0131 olmas\u0131 halinde, yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fcn\u00fcn ge\u00e7erlili\u011fi temsile yetkili organ taraf\u0131ndan verilmi\u015f olmas\u0131na ba\u011fl\u0131d\u0131r . (Yarg\u0131tay 6. Hukuk Dairesinin 26.02.2014 tarihli ve E. 16778 K. 2152 say\u0131l\u0131 karar\u0131)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Tahliye Tarihi a\u00e7\u0131k ve net bir \u015fekilde belirtilmelidir.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u201cKira s\u00fcresi 01.05.2012 tarihinden ba\u015flayarak 3+2 y\u0131l olarak kararla\u015ft\u0131r\u0131lm\u0131\u015f olup bu s\u00fcrenin sonunda kirac\u0131 mecuru bo\u015faltarak kiraya verene kay\u0131ts\u0131z \u015farts\u0131z teslim edecektir.\u201d \u015feklinde taahh\u00fcd\u00fcn yer ald\u0131\u011f\u0131, daval\u0131n\u0131n 01\/02\/2005 tarihli kira s\u00f6zle\u015fmesine g\u00f6re bu tarihten itibaren kiralanan ta\u015f\u0131nmazda bulundu\u011fu, s\u00f6z konusu taahh\u00fcd\u00fcn kira ili\u015fkisi devam ederken verilen tahliye taahh\u00fcd\u00fc oldu\u011fu ancak taahh\u00fcd\u00fcn belli bir tarihi i\u00e7ermedi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Tahliye taahh\u00fcd\u00fcnde, tahliye tarihi belli (a\u00e7\u0131k) bir \u015fekilde yer almad\u0131\u011f\u0131ndan tahliye taahh\u00fcd\u00fcn\u00fcn varl\u0131\u011f\u0131ndan bahsedilemez.( Yarg\u0131tay 12. Hukuk Dairesinin 9.3.2020 tarihli ve E. 2020\/1175 K. 2020\/2309 say\u0131l\u0131 karar\u0131)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u015earta ba\u011fl\u0131 tahliye taahh\u00fctnamesi yap\u0131labilir, s\u00fcreler \u015fart\u0131n ger\u00e7ekle\u015fmesi ile ba\u015flar\u00e7<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u201cDavac\u0131 kiralayan\u0131n icra takibinde dayand\u0131\u011f\u0131 tahliye taahh\u00fcd\u00fc kira ve aidat bor\u00e7lar\u0131n\u0131n \u00f6denmesi \u015fart\u0131na ba\u011flanm\u0131\u015ft\u0131r. Bor\u00e7lar Kanunu\u2019nun 149. maddesi h\u00fckm\u00fc gere\u011fi s\u00f6zle\u015fmeler \u015fartl\u0131 yap\u0131labiliyorsa bunun do\u011fal sonucu olarak tahliye taahh\u00fctnameleri de \u015fartl\u0131 d\u00fczenlenebilir. Bu takdirde taahh\u00fct \u015fart\u0131n ger\u00e7ekle\u015fmesi ile g\u00fcncellik kazan\u0131r ve icra takibinin de \u015fart\u0131n ger\u00e7ekle\u015fmesinden itibaren bir ay i\u00e7inde yap\u0131lmas\u0131 gerekir. (Yarg\u0131tay 6. Hukuk Dairesinin 07.04.2009 tarihli ve E. 2009\/1388 K. 2009\/2938 say\u0131l\u0131 karar\u0131)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Taahh\u00fctnameye cezai \u015fart eklenebilir ancak,  Mahkeme taraf\u0131ndan hakkaniyetli olup olmad\u0131\u011f\u0131 incelenmesi gerekir.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u201cDavada 01.01.2008 ba\u015flang\u0131\u00e7 tarihli ve 3 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi konusunda taraflar aras\u0131nda bir uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Bu s\u00f6zle\u015fmeye istinaden daval\u0131 taraf\u0131ndan 01.03.2008 tarihinde davac\u0131 kiraya verene tahliye taahh\u00fcd\u00fc verilmi\u015f, tahliye taahh\u00fcd\u00fcnde daval\u0131 kirac\u0131 kiralanan\u0131 31.12.2010 tarihinde tahliye edece\u011fini taahh\u00fct ettikten sonra devam\u0131nda \u201ckirac\u0131 mecuru 31.12.2010 tarihinde tahliye etmezse tahliye tarihinden \u00f6nceki ayl\u0131k kira bedelinin 3 kat\u0131 miktar\u0131nda ayl\u0131k \u00f6demeyi kabul ve taahh\u00fct eder\u201d denilmi\u015ftir. \u0130lgili taahh\u00fct cezai \u015fart niteli\u011findedir ve ge\u00e7erlidir. Bu nedenle daval\u0131 kirac\u0131y\u0131 ba\u011flar. Daval\u0131 tahliye taahh\u00fcd\u00fcne ra\u011fmen kiralanan\u0131 tahliye etmemi\u015ftir. Bu nedenle mahkemece, tahliye taahh\u00fcd\u00fcndeki<br>d\u00fczenleme gere\u011fince cezai \u015fart\u0131n daval\u0131dan tahsiline karar verilmesinde bir usuls\u00fczl\u00fck bulunmamaktad\u0131r. Ancak mahkemece TBK 182\/son (BK. 16l\/son) maddesine g\u00f6re cezai \u015fartta indirim yap\u0131l\u0131p yap\u0131lamayaca\u011f\u0131 tart\u0131\u015f\u0131lmam\u0131\u015f, cezai \u015fartta bir indirim yap\u0131lmam\u0131\u015ft\u0131r (Yarg\u0131tay 6.
